RC Heald, Quincy, Ill., driver of the car which hit and killed Mrs. HW Bellamy in Wever, Iowa late Saturday, was held responsible for the death by a coroner’s jury at an inquest conducted by Coroner Walt Clements of Lee County, in Wever, this morning.
The jury in its verdict held that Heald was driving at “an unlawful rate of speed, and did not have proper control of his car.“
Robert N. Johnson, Jr., county attorney, this afternoon, said that no charges have yet been placed against Mr. Heald. He said, however, that his office would carry out the instructions of the coroner’s jury.
The coroner’s jury verdict in part declared that: “Trom the testimony heard, we believe that said RC Heald was driving at an unlawful rate of speed and did not have the car under proper control”.
“And we do further find that she did come to her death feloniously; and that a crime has been committed on the deceased, and that RC Heald is the name of the person whom the jury believe has committed it.”
Funeral services for Mrs. Bellamy will be held in the Giles Funeral Home in Burlington, Iowa at 2 p.m. Tuesday. Mrs. Bellamy, 72, was killed in Wever when she attempted to cross Highway 61 on her way to her home from a Wever store.
Services will be conducted by Rev. Jerome Miller, pastor of Trinity Lutheran Church in Burlington and burial will be in Aspen Grove Cemetery, Burlington.
Mrs. Bellamy was killed instantly when hit by the car driven by Mr. Heald, when she stepped from behind a team driven by William Patterson of Wever, directly in the path of the Heald car. Both the team and the car were traveling south on the highway.
Mr. Heald, secretary of the YMCA in Quincy, was en route to Quincy from Burlington with members of the Quincey YMCA swimming team who had participated in a contest in Burlington on Saturday afternoon. The accident occurred at about 5:30 pm. In the car with Mr. Heald were Howard Powers, coach of the swimming team; Junior Powers, John Ewing, Bill Durham, and Bob Miller, members of the team.
In relating the circumstances leading to the accidents, Mr. Heald said Saturday night that he was driving through Wever and was attempting to pass the team driven by Mr. Patterson.
“I did not see Mrs. Bellamy until she stepped directly into the path of my car from behind the team,” Mr. Heald said, “We hit hare almost before we knew of her presence on the highway.”
Mrs. Bellamy had been visiting a store operated by her daughter and son-in-law, Mr. and Mrs. Kenneth Huebner, and was on her way to her home which is located directly across the street from the Huebner store.
Walt Clements, Lee Count coroner was called to the scene of the accident and the body was removed to the Giles Funeral Home in Burlington.
Mrs. Bellamy, new, Miss Rosa Bawman, was born in Washington, DC, on August 30, 1868. She was married to WH Bellamy in Burlington, Iowa December 16, 1896, Mr. and Mrs. Bellamy took up their residence in Wever about seven years ago.
Surviving are her husband; two sons, Charles M. Bellamy, Galesburg, Ill., and Wilfred C. Bellamy, Los Angeles, Cal.; one daughter, Mrs. Kenneth Huebner, Wever; four brothers, Charles Bawman, Samuel Bawman, Frank Bawman, all of Burlington, and three sisters, Mrs. Emma Piggott, River Forest, Ill
